Assisting Non-Party Merchants and Business Owners Against Financial Giants

Over the past several years, hundreds of merchants across the country have allegedly suffered from the abuses by MasterCard/Visa in a highly-publicized anti-trust case. Merchants rejected a settlement in 2012 but as of 2018 all parties have agreed on a resolution and the court has tentatively approved this settlement. (Claim forms are not yet available)

Attorney John Bickel represents non-party merchants in their attempt to achieve economic success. With over 40 years of experience in complex business and commercial litigation cases, Mr. Bickel has earned a reputation as an aggressive trial attorney. In this case, he will use both his authorization to receive interchange data and potentially expert testimony to advocate for each merchant he represents. Merchants across the country, from huge enterprises to local business owners, have allegedly suffered the effects of price-fixing tactics by MasterCard and Visa. Although representing only non-party merchants in the damages phase of this class action, he will utilize the authorization to work with payment processors in an attempt to check the data provided to the trustee by MasterCard and Visa in order to prove the merchants’ damages. He will uncover:

  • – Data concerning how much MasterCard and Visa spend by each merchant’s customers;
  • – The interchange fee charged to merchants;
  • – The possible recovery amount for each merchant; and
  • – Any chargebacks that have been refunded by the merchants.

Many anticipate judicial approval for the settlement in 2019.
